Florida Security Guards; Don’t Leave Yourself Liable

Whether it’s a New Year’s Eve celebration, private party, business, community, school, or apartment, safety is of the utmost importance. Anywhere many people gather increases the probability of criminal activity.  Add alcohol into the mix and it can quickly become a dangerous situation.

A recent report by the FBI shows violent crimes and property crimes have increased over the last couple of years. The report cites the top crimes in the country are robbery, murder, burglary, assault, property crime and theft.

“The owner or operator of a convenience business that substantially implements the applicable security measures shall gain a presumption against liability in connection with criminal acts that occur on the premises and that are committed by third parties who are not employees or agents of the owner or operator of the convenience business.”  Florida Statutes Section 768.0705

Negligent Security

 

In Florida, if a commercial or residential, owner is responsible for providing a safe environment. Failing to take adequate security measures, means you could be held responsible if something happens on your property. Failing to take reasonable steps to protect those on your property from foreseeable harm is considered negligent security.

 

Premises Liability

 

Property managers and owners are legally responsible their property is safe for visitors. The property owner must furnish reasonable security, this is premises liability. This includes hiring security guards, provide adequate lighting in dark areas, installing security cameras, or implementing controlled access systems.

In high traffic areas such as commercial properties, residential communities, public spaces, and hotel venues. entertainment venues, shopping plazas, parking lots, communities, events, and parties, the property owner is responsible for hiring trained security personnel. If a security guard is not hired and a visitor is injured due to a criminal incident, the property owner would be held liable.

 

Failing To Provide Reasonable Security Leaves An Owner At Risks Under Florida Law

 

Commercial properties include: Shopping areas, nightclubs, restaurants, and retail stores.

Residential properties include: Multifamily housing. apartment buildings, housing communities, and condominium complexes. This also includes the parking lots.

Public spaces include: Transportation hugs, parks, parking garages, and events.

Hotels and Hospitality Venues include: Resorts, motels, hotels, and outside events. Especial here in Central Florida where diverse visitors are attracted to.
