Both institutions have decided to take a proactive approach to the problem rather than waiting for the information to be used by those responsible. American Express and the Bank of America are monitoring the situation and will replace cards if the begin to see misuse of the data. Businesses and individual are being attached in ever increasing number due to the relative ease and difficult prosecution of those found responsible. A number of people have simply moved their illegal operation “off shore” to complicate the investigation and prosecution of those responsible. In addition criminals are not facing the tougher sentencing that they would face if they committed actual robberies. These crimes can be done at the convenience of a personal computer while sitting at a desk. This may be why we are seeing such a reduction in traditional crime; the criminals have migrated to cyberspace.
